Court directs ex PC Chelogoi Sh1.3 B land case,others to proceed with trial magistrate

A Nairobi court through its Chief Magistrate court has directed that the matter involving a former provincial commissioner, Davis Nathan Chelogoi, and Assistant Deputy Director in the Lands Administration Office, Andrew Aseri Kirungu, proceed with the trial Magistrate.

Milimani Chief Magistrate Lucas Onyina on Wednesday directed the matter to proceed before Trial Magistrate Dolphina Alego, where he instructed the matter to be mentioned before her on January 28, 2026.

The Magistrate decided after the victim’s lawyer wrote a letter to the court seeking that the trial Magistrate proceed with the matter to a conclusion since the accused persons had put in their defence

“Though the trial court is on transfer to a neighbouring Division, I hereby direct the matter to proceed with the trial Magistrate, where she can allocate the dates to conclude the matter, ” Onyina said.

The Magistrate further directed the matter to be mentioned before Dolphina Alego on January 28, 2026, for the purpose of directing how to proceed.

Kirungu was further charged with fraudulently obtaining a Land registration number.

The prosecution alleged that on diverse dates between May 2020 and June 2021, Kirungu and Chelogoi, while at the State Department of Lands and Physical Planning in Nairobi, with intent to defraud, procured registration of the said land by falsely pretending the land belonged to Chelogoi.

He was further charged with abuse of office contrary to section 101 of the Penal Code.

According to the Prosecution, Kirungu on diverse dates between December 2020 and May 2021 at the State Department of Lands and Physical Planning in Nairobi, a person employed in the Public service as an Assistant Deputy Director in the Lands Administration Officer, for gain, fraudulently made certificate of Title in abuse of the authority of his office which was prejudicial to the alleged legal owners of the said land.

After the full hearing, the duo were found with a case to answer and were put on their defence.
