The Director of Public Prosecutions (DPP), Renson Igonga, has cleared officials of a Mau Mau led group headed by James Njuguna Mahuria of allegations related to fraud.
In a letter signed on behalf of the DPP by Principal Prosecution Counsel Mokaya Nyakundi and copied to the investigating officer in West Pokot, the DPP stated that there was insufficient evidence to proceed with the case.
The letter, dated January 9, 2026, indicated that the DPP had reviewed the police file and accompanying evidence concerning allegations of obtaining money by false pretences against officials of the organisation known as Mau Mau Children Post-Colonial Elites.
“Pursuant to a court order dated May 19, 2025, in Miscellaneous Application No. 40 of 2025, the investigating officer was authorised to investigate the accounts and records of Mau Mau Children Post-Colonial Elites,” the letter read in part.
The DPP noted that the evidence presented showed the organisation was duly registered as required by law, operates legally within the country, and that its membership is voluntary.
According to investigations and documents submitted, the organisation’s bank account at Kingdom Bank was opened after meeting all statutory requirements, and its financial operations were conducted within the law.
“In light of the above, the elements necessary to sustain the aforementioned offence have not been disclosed. The evidence as presented fails to meet the threshold required to charge the suspects with the offence of obtaining money by false pretences. I therefore direct that the file be closed with no further police action,” the DPP concluded.
This development comes ahead of the anticipated disbursement of compensation funds from the UK government to registered next of kin of Mau Mau fighters.
Mahuria told Daily News Kenya–International that the compensation process is scheduled to commence on January 27, 2026.
He added that members have been advised to open bank accounts with the National Bank of Kenya (NBK), through which the funds will be deposited.
