A Nairobi based journalist has moved to the High Court seeking protection from arrest after being named by the Directorate of Criminal Investigations (DCI) in connection with the alleged staged disappearance of former Cabinet Secretary Raphael Tuju.
In an urgent application filed at the Milimani Law Courts, Zipporah Wambui is seeking anticipatory bail, saying the DCI’s public declaration has placed her liberty and safety at risk.
Through her lawyer, Danstan Omari, Wambui told the court that she had been wrongly profiled.
“The applicant has been erroneously and unjustifiably linked to individuals she does not know and has never interacted with,” Omari submitted.
In a supporting affidavit, Wambui maintained that she only learnt of the alleged disappearance through routine media coverage.
“I became aware of the alleged incident through media reports and communication with colleagues, just like any other journalist covering a developing story,” she stated.
She explained that her presence at press briefings in Karen was purely professional, undertaken in the course of her duties as a journalist.
“Any interaction I may have had with sources or persons connected to the story was strictly for purposes of newsgathering,” Wambui told the court.
According to the application, her concerns escalated on April 3 when the DCI, through its communications office, publicly named her as a person of interest in what investigators described as a staged disappearance.
“The said publication has caused me great fear and apprehension of imminent arrest and harassment despite having committed no offence,” she said.
Wambui further told the court that attempts to seek clarification from investigators have gone unanswered.
She described herself as a seasoned journalist with over 15 years’ experience and accreditation from the Media Council of Kenya, adding that she is willing to cooperate with any lawful investigations.
“I am a law-abiding citizen ready and willing to cooperate with authorities, provided due process is followed,” she said.
In her petition, she is seeking anticipatory bail of KSh20,000 and orders barring the DCI and the Office of the Director of Public Prosecutions from arresting or intimidating her without due process.
“This Honourable Court’s intervention is necessary to safeguard my constitutional rights, including freedom of the media, liberty and fair treatment under the law,” she added.
