A Nairobi court has issued warrants of arrest against a doctor and her co-worker accused of administering an unregistered drug to a patient without proper diagnosis or professional care.
The warrants were issued on Wednesday by Milimani Senior Principal Magistrate Teresa Nyangena after the two accused,Jane Njeri Kamau and Vivian Chebet Masai failed to appear in court for plea taking at the Milimani Law Courts.
In her ruling, Magistrate Nyangena said the accused persons had “no reasonable explanation for their absence” and directed that warrants of arrest be issued against them.
The court scheduled the matter for mention on March 24, 2026.
According to the charge sheet, Kamau, described as a medical practitioner, and her co-accused Masai are facing charges relating to alleged professional negligence and the use of an unregistered drug.
The prosecution alleges that on March 1, 2025, at an unknown location within the Republic of Kenya, the two unlawfully carried out a negligent act during the treatment of Nancy Muthoni Warutumo.
It is alleged that they administered an unregistered drug, Mounjaro (Tirzepatide 7.5mg), without proper diagnosis, due care, or professional diligence.
The first count against both accused is negligence causing harm, contrary to Section 243 of the Penal Code.
In a second count, Kamau is separately charged with the sale and supply of unregistered drugs, contrary to Rule 3 as read with Rule 11 of the Pharmacy and Poisons (Registration of Drugs) Rules.
Prosecutors allege that she unlawfully sold or supplied the drug to the complainant despite it not being registered by the Pharmacy and Poisons Board, as required by law.
The court warned that failure to obey its orders would attract penal consequences, noting that continued non-attendance could lead to further legal action once the warrants are executed.
The case now awaits the arrest and presentation of the accused persons before court for plea taking.
