ODPP Prosecutor Charged With Receiving Sh30,000 Bribe to Withdraw Makadara Case

A senior prosecution counsel attached to the Office of the Director of Public Prosecutions has been charged with receiving a bribe from an accused person in exchange for allegedly withdrawing a criminal case pending before the Makadara Law Courts.

Samuel Mugo Kiarie appeared before Senior Principal Magistrate Isabella Barasa at the Anti-Corruption Court in Nairobi where he faced three counts of receiving a bribe contrary to Section 6(1) as read with Section 18 of the Antiโ€‘Bribery Act.

According to the charge sheet, the prosecutor allegedly solicited a financial advantage of Sh30,000 from Elly Vujeri Mukosero, an accused person in Makadara Chief Magistrateโ€™s Court Criminal Case No. 1555 of 2022, in which Mukosero was the accused.

The prosecution told the court that on October 17, 2023, within Nairobi, Kiarie, while serving as a senior prosecution counsel with the ODPP, allegedly requested the money from Mukosero with the intention that he would withdraw the criminal case that had been filed against him.

In a second count, the court heard that on October 24, 2023, Kiarie again allegedly requested Sh30,000 from Mukosero under similar circumstances, promising to facilitate the withdrawal of the case.

The third count states that on the same date, October 24, 2023, the prosecutor allegedly received Sh20,000 from the accused person as part of the requested bribe in order to influence the withdrawal of the case.

The charges indicate that the alleged offences were committed while Kiarie was serving as a public officer in the Office of the Director of Public Prosecutions.

He appeared before the Anti-Corruption Court following investigations into the alleged bribery incident.

After taking plea, Magistrate Barasa released the accused on a bond of Sh1 million with a surety of a similar amount. In the alternative, the court allowed him to secure his release on cash bail of Sh200,000.

The court directed that the matter will be mentioned on April 30, 2026 for further directions.
