The Nyali Beach Management Unit has obtained a temporary injunction to stop the ongoing dismantling and destruction of a barge along Mkomani Dimbwi Rose/Kenyatta beach within the Indian Ocean.
The National Environment Tribunal (NET) sitting in Nairobi under stewardship of Emmanuel Mumia issued the temporary stoppage order until the matter is heard and determined.
The Centre for Litigation Trust had moved to the Environment Tribunal under certificate of urgency through an inter-parties application.
The matter will be mentioned on March 27 to confirm compliance and to take the ruling date.
The Environment Tribunal directed the Centre for Litigation to serve the National Environment Management Authority (NEMA), Maast Maritime (K) Limited, Finest Steel and Metal Ltd and Joseph Mwangi.
Meanwhile, the adjacent beach famously known as Samaki Lane is within retired President Uhuru Kenyatta’s private residence and the residences of other prominent personalities in the coast region.

Nyali Beach Management Unit chairman Said Hamid had accused local politicians of working with scrap metal dealers in the ongoing exercise which had affected fishing in the area.
He had pointed out that the ongoing dismantling of the barge for scrap metal has affected the marine ecosystem along the Mkomani beach area.
“Our members who depend on fishing to earn a living are suffering as they are counting losses due to the ongoing exercise,” he had said.
Hamid had added that the dismantling and destruction of the barge has led to an oil spill and other forms of pollution of the sea.
The unit members who held a protest along the beach area said they had exhausted all avenues for their problems to be heard before resorting to the protest action.
Hamid had said it is regrettable that none of the elected leaders in the area has come to their rescue.
“We have gone from one office to another to seek for intervention but it has all proven to be futile,” he had pointed out.
The unit chairman had said to make matters worse even the county government has abandoned them.
Hamid had said they have a membership of over 300 fishermen whose livelihood depends on the fishing in the area.
