A family in a property ownership dispute in Nairobi South B near KIMC has accused an auctioneer of unlawfully evicting them from a residential home they say, they have occupied for more than two decades.
The family said that the eviction was done despite it obtaining a court order stopping the eviction.
They added that the dispute revolves around a property owned by Janet Kabugi Nyaguthie, with Harun Nyakundi Nyambariga and Carren Moraa Tweya listed as claimants.
The eviction according to the family was reportedly carried out by auctioneer Zachariah Baraza of SIUMA Auctioneers who is also an aspirant for Bungoma Gubernatorial seat.
According to Nyaguthie, her family was forcefully removed from the house without prior notice after the claimants obtained an order from a tribunal directing them to vacate the premises.

She maintains that they have lived on the property for over 20 years and alleges that a sitting Member of Parliament (name withheld) is behind the circumstances that led to their eviction.
The claimants on their part argue that Nyaguthie had been paying a monthly rent of Sh50,000.
However, the family disputes the claim, saying there is no tenancy agreement or any documentary evidence proving the existence of a landlord-tenant relationship.
Nyaguthie further states that she holds the title deed for the property and has consistently paid annual land rates to the county government of Nairobi which she says demonstrates her ownership of the land.

Following the tribunal’s directive Nyaguthie obtained a stay order halting the eviction and says the order was duly served upon the auctioneers.
Despite this, she alleges that the auctioneers proceeded with the eviction, destroyed parts of the property and threw out the family’s personal belongings.
The family is now demanding justice and accountability, insisting that the eviction was carried out in defiance of a valid court order.
