The high court has halted the decision of the Judicial Service Commission (JSC);from forwarding a letter to the president to appoint a tribunal to investigate a sitting judge.
A three judge bench comprising of Justice Onesmus Makau, lady Justice Jemimah Keli and Justice Dr Jacob Gakeri issued the orders restraining further actions by the JSC against justice Anthony Ombwayo.
The judges said that they were satisfied by the application filed by Justice Ombwayo through his lawyer Neville Amolo.
They said, the decision by JSC seeking the formation of a tribunal was not well thought and was in contravention of the constitution.
Justice Ombwayo while sitting in Nakuru high court was presented two files relating to land matters and upon hearing parties, he dismissed the application by the petitioners and upon dissatisfied they filed an appeal before the appellate court and their application seeking stay of the decision by judge Ombwayo was disallowed.
The petitioners had applied to have justice Ombwayo not hear their petition.
According to the judge, the petitioners did provide sufficient evidence for recusal.
The petitioners having dissatisfied with the decision by the judge, they sought his removal through the judicial service commission (JSC).
