A city lawyer has been charged for an offence of allegedly obtaining Sh35 million from a Nigerian investor in Gold transaction business.
The accused Alphonse Collins Odoyo Osewe who has been on the run for over one year since the matter was registered before Milimani chief Magistrates court was arrested on Wednesday at Milimani courts by the investigating officer while accompanying a battery of other lawyers who represented Mukuruweini MP John Kaguchia who was indicted for an offence of incitement.
Prosecuting counsel Hillary Isiagho told Chief Magistrate Gethi Kibiru, that the accused obtained the money from Bernard Shiaundu Aete between May 1 and 9,2023 by falsely pretending that he was in a position to supply him 400 kilogrammes of Gold.
The prosecution told the court the accused received Sh26 million from Adeyeye Enitan Ogunwusi concerning the same transaction.
The prosecutor told the court that it should consider to deny releasing the accused on bail or bond due to his character of disobeying summons to appear in court.
Isiagho said that the accused evaded arrest by changing his area of abode after the warrant of arrest was issued by the former chief Magistrate Lucas Onyina.
He said his co accused patroba Odhiambo Tobias was charged over a year ago and subsequently released on a bond of Sh2 million.
The prosecution pointed out that the accused is a flight risk who should not be entrusted with bond or bail.
He further told the court that during the arrest of the accused he uttered abusive words against the arresting officer, who have since reported the matter to central police station.
The trial Magistrate directed the accused be remanded at Kilimani police station until 6th of August 2026 when he will deliver his ruling as to whether he will be released on bond or bail.
