Nairobi City County has strengthened its alternative planning grievance resolution mechanism following the swearing-in of the Chairman of the Nairobi Physical Planning and Land Use Liaison Committee, a quasi-judicial body established under the Physical and Land Use Planning Act, 2019.
The committee provides an alternative grievance resolution avenue for members of the public who are dissatisfied with planning decisions made by the County’s Built Environment and Urban Planning Sector.
Its eight members are drawn from the Law Society of Kenya (LSK), National Land Commission (NLC), National Construction Authority (NCA), Kenya Institute of Planners (KIP), Architectural Association of Kenya (AAK), Institution of Surveyors of Kenya (ISK) and the Kenya National Chamber of Commerce and Industry (KNCCI).
The swearing-in of the Chairman, Advocate Rogers Monda, unlocks an opportunity for citizens to have planning related grievances heard within 30 days of filing an application, providing a faster alternative to lengthy court processes.
The mechanism also enables the County to save significant legal costs, as disputes are heard and determined within a short period without the need to engage external lawyers.
The oath of office was administered by the Acting County Attorney, Mr Boniface Waweru, during a ceremony witnessed by the County Executive Committee Member for Built Environment and Urban Planning,Patrick Mbogo, members of the Liaison Committee and the committee secretariat, including Director of Urban Policy and Research, Planner Ruth Waruguru, and Abraham Gitonga of the Legal Department.
In his remarks after taking the oath of office, Advocate Monda pledged to uphold the Constitution of Kenya and the laws of the Republic of Kenya in the discharge of the committee’s mandate, while ensuring that all complaints and appeals are handled within the timelines stipulated by law.
Immediately after the swearing in ceremony, the committee commenced its work by hearing appeals that had been filed before the County, with six matters heard and determined.
The operationalisation of the Liaison Committee underscores Nairobi County’s commitment to accelerating planning decision-making and enhancing service delivery for the benefit of Nairobi residents.
