Former Nairobi County Finance Executive Committee Member Charles Kerich has avoided serving a three month jail term after the High Court set aside contempt orders issued against him in a long running Sh106 million legal fees dispute.
During a court appearance on Thursday, the parties informed the judge that they had reached a settlement outlining how the outstanding amount will be cleared.
As part of the agreement, Kerich has already paid Sh30 million to the law firm, with the balance to be settled in installments under a payment schedule filed before the court.
Kerich told the court that delays in settling the debt were caused by administrative processes within Nairobi County, rather than a deliberate refusal to comply with court orders.
Earlier this month, the High Court had found Kerich in contempt of court and ordered him to surrender within three days to begin serving a three month prison sentence.
The court further directed that if he failed to present himself, police should arrest him immediately, warning that he would be treated as a fugitive from justice.
However during today’s mention the court was informed that the parties had resolved the dispute through a negotiated payment plan.
After considering the agreement and noting Kerich’s expression of remorse, the judge vacated the contempt orders, allowing him to remain free as he complies with the agreed settlement terms.
