AG Dorcas Oduor Launches Multi-Sectoral Committee to Align Kenya’s Laws with the Constitution

Attorney General Dorcas Oduor has raised concern over the continued existence of laws and statutory provisions that have already been declared unconstitutional by Kenyan courts but remain on the country’s statute books.

Speaking on Tuesday during the launch of the Multi-Sectoral Committee on Legislative Reforms and Alignment at Sheria House, Oduor said the failure to repeal or align such provisions has exposed the Government to costly and unavoidable constitutional litigation while hindering the efficient administration of justice.

“The presence of statutes and provisions on our law books that have been invalidated by our courts but remain unattended, unrepealed, or unaligned has exposed the Government to costly and unvoidable constitutional disputes and is also hindering the seamless delivery of justice to Kenyan citizens,” she said.

The Attorney General noted that aligning Kenya’s legal framework with the Constitution and court decisions is essential in strengthening the rule of law, enhancing legal certainty and improving public confidence in the justice system.

The newly launched Multi-Sectoral Committee is expected to review existing legislation, identify provisions that are inconsistent with the Constitution or judicial pronouncements, and recommend reforms to ensure Kenya’s laws remain current and constitutionally compliant.

The event was also attended by Solicitor General Shadrack Mose and Kenya Law Reform Commission Director Christine Agimba, alongside other officials drawn from key institutions involved in legislative reform.
