High Court rejects bid to audit rent from Sh150 Million Huruma building

By Johnson Njenga,Milimani Court.

The High Court has dismissed an application by Oksana Investment Limited seeking an audit of rental income collected from a Sh150 million, seven storey building in Huruma, Nairobi, owned by an elderly woman aged over 80.

Justice Peter Mulwa of the Commercial and Tax Division cited numerous similar applications previously filed by the company, which he said were aimed at delaying the hearing of the ongoing suit.

Oksana Investment Limited has filed a case against Alice Wanjiru Wamwea over the ownership of the multi-storey building, with the dispute now before the court for determination.

Lawyer Harrison Kinyanjui, who is representing Wamwea, told the court that he would present the remaining four witnesses when the hearing resumes on February 2, 2027.

The witnesses are expected to help the court establish the facts surrounding the ownership dispute and pave the way for the determination of the case.

The latest ruling comes as the court seeks to proceed with the substantive hearing of the dispute over the valuable property and its rental income.

The ownership of the building remains a matter for the court to determine as the parties continue presenting their respective cases.
