Senior Counsel Dr. Muthomi Thiankolu:A leading constitutional lawyer

Dr. Muthomi Thiankolu has emerged as one of Kenya’s most prominent constitutional lawyers, earning national recognition through his involvement in several landmark legal and political cases.

He rose to widespread prominence during the impeachment proceedings against former Deputy President Rigathi Gachagua, where he represented the state.

During the hearings, Thiankolu distinguished himself through his rigorous cross-examination of Kibwezi West MP Mwengi Mutuse, the sponsor of the impeachment motion.

He argued that the allegations against Gachagua including claims of unexplained wealth and conduct deemed to undermine the Presidency amounted to serious misconduct that threatened the proper functioning of government.

His legal prowess was again on display when Gachagua challenged his impeachment before the High Court.

Thiankolu strongly opposed submissions made by the former Deputy President’s legal team, notably criticizing what he termed their “pendulum tactics” in seeking conservatory orders to halt the impeachment process.

He also successfully challenged medical records submitted by Gachagua’s personal physician, Dr. Dan Gikonyo.

Thiankolu had earlier featured prominently in the 2022 Presidential election petition filed by the late ODM leader Raila Odinga.

As part of the team representing President (then Deputy President) William Ruto, who had been declared President elect by the Independent Electoral and Boundaries Commission (IEBC), he delivered one of the proceedings’ most memorable remarks.

“The case before you is much ado about nothing and you must tell the petitioner that this is not the Supreme Court of the Republic of Kusadikika; it is the Supreme Court of the Republic of Kenya,” he told the court.

Beyond electoral and constitutional litigation, Thiankolu has also handled other high profile matters.

He represented former Agriculture Cabinet Secretary Mithika Linturi in his protracted divorce case against his estranged wife, Aldai MP Maryanne Ketany.

In his 40’s, Dr. Thiankolu is a Partner at Muthomi & Karanja Advocates and a Senior Lecturer at the Faculty of Law at the University of Nairobi (UoN).

A Senior Counsel with more than 18 years of legal practice, he is a Commonwealth Scholar and the recipient of numerous honours and awards, including the Senior Counsel distinction, the C.B. Madan Award, the Moran of the Order of the Burning Spear (MBS), the Litigation Practitioner of the Year Award, and the Lawyer of the Year Award (runner-up).

His areas of specialization include constitutional and administrative law, electoral law, public procurement law, dispute resolution, and international economic law.

Over the years, he has provided consultancy services to several local and international institutions, including the World Bank Group, the United Nations Office on Drugs and Crime, the German Development Cooperation, the Judicial Service Commission of Kenya, the Public Procurement Regulatory Authority, the International Development Law Organization, the Law Society of Kenya, and the Research Foundation of the State University of New York.

Academically, Dr. Thiankolu holds a Doctor of Philosophy (PhD) in Law from the University of Nairobi.

He also earned a Master of Laws (LLM) in International Economic Law, with distinction, from the University of Warwick in the United Kingdom, a Postgraduate Diploma from the Kenya School of Law, and a Bachelor of Laws (LLB) degree from the University of Nairobi.

Despite his remarkable achievements, Thiankolu while chatting with DNK-International recently attributed his determination and success to the hardships he endured while growing up in rural Meru.

He has spoken about overcoming extreme poverty and the challenges associated with jigger infestation, experiences that shaped his resilience and work ethic.

Away from the courtroom and lecture hall, the Senior Counsel is a family man. He is married and is blessed with three children.

He’s also a farmer with a keen interst on cattle rearing.
