A High court judge has directed parties involved in Sh 3.6 Billion monies paid to ghost workers from Bugoma county to file their submissions in respect to the application seeking her disqualification.
Justice Roselyn Aburiri directed parties to ensure the timeline issued by the court be taken seriously by the parties.
Four applicants through their lawyer Bernard Odero Okello sought the judge to recuse herself and the matter be heard by a different judge.
He said that the applicants have expressed dissatisfaction in the manner in which the court is handling their case.
The lawyer told justice Aburili that the county government has been losing huge sum of money that was paid to 463 children who had not attained age to satisfy them to be employed in the County government.
The money in question was paid to relatives and children who never served the county Council or county government.
The lawyer told the court that their is sufficient evidence and documents showing how a union member by the name Roba Duba has been misusing county monies to either pay himself or pay close relatives and law firms which now the petitioners are now calling Duba to account for.
The lawyer further submit that the judge has already expressed biased and application has been filed seeking her disqualification.
He said the petitioners Bernard Barasa, Kennedy Wafula, George Nganga and Prof. Fredrick Onyango have given him firm instructions to ask the judge to disqualify herself from hearing the petition.
He said the matter before the court raises serious issues of jurisdiction and loss of money belonging to the county government.
