Former Kiambu Governor Ferdinand Waititu will await clarification from the High Court on who should be convicted of money laundering following a dispute over the interpretation of an appellate judgment.
Anti-Corruption Chief Magistrate Harrison Barasa said the prosecution and defence were yet to agree on whether Waititu, his wife Susan Wangari and Charles Chege should be convicted of the offence, for which they had previously been acquitted.
The prosecution appealed against the acquittal, and High Court Judge Rose Ougo ruled that the trial court had erred in law by discharging the accused on the money laundering charge.
Justice Ougo directed Waititu and his co-accused to appear before the Anti-Corruption Court for mitigation and sentencing.
However, the parties are seeking clarification on the specific individuals affected by the ruling.
Magistrate Barasa scheduled the matter for mention on October 27 to confirm whether the clarification has been obtained.
The prosecution had presented evidence that Waititu corruptly received Sh25.6 million through companies associated with him, including Saika Two Estate Developers, while Sh7.2 million was allegedly channelled to his wife through Bienvenue Delta Hotel.
Waititu was sentenced to 12 years in prison or ordered to pay a fine of approximately Sh52.7 million.
He was also barred from holding public office for 10 years.
