The wife and brother of slain prominent North Rift farmer and businessman Joseph Njenga Njuguna have denied charges linking them to his murder.
Mary Muthoni Ngethe and Michael Maina Karembesha appeared before Kitale High Court Judge Robert Limo, where they denied jointly murdering Njuguna on the night of July 29 and 30 at Maili Tano area in Twiga Location, Endebess, Trans Nzoia County.
Prosecutor Mark Magun opposed their release on bond, arguing that they could interfere with witnesses, some of whom are family members and neighbours.
Magun also told the court that the alleged murder occurred at the deceased’s matrimonial home and that, given Njuguna’s prominence in the area, the accused could face hostility from members of the public if released.
Defence lawyers Jason Kimani and David Teti asked the court to grant the two lenient bond terms, arguing that bail is a constitutional right.
The lawyers proposed that Muthoni, who has a second matrimonial home in Ruiru, Kiambu County, could be ordered to stay there to prevent contact with witnesses.
They said Karembesha could similarly be ordered to rent a house in Kitale or elsewhere.
Judge Limo ordered the probation department to prepare a report within seven days to guide the court in determining the bond application.
The court will deliver its ruling on the bond application next Thursday.
