A civil society trading as Vocal Africa has filed a constitutional petition before the high court seeking to halt the speaker of the National assembly and his counter part from the senate from engaging in partisan politics.
The petitioner through it’s lawyer Ian Mutiso told journalists at Milimani law courts, that the application before the court raises serious issues touching on Moses Wetangula and Amason Jeffah Kingi for violating the constitution which mandate is not bestowed upon them while serving their respective offices.
He said that the petitioner will be asking the constitutional that the two speakers have acted unlawfully and if they want to participate in politics they should resign from their offices.
The lawyer said that parliament and the senate are institutions established under the constitution and those heading those offices must respect the rule of law.
Mutiso says that Wetangula and his counter part Kingi have been engaging themselves in campaigning for a particular presidential candidate which action amounts to the abuse of office.
The petitioner has also sued the independent Electoral boundary commission, the Ethics and Anti corruption commission and the Attorney general as the respondents to the petition.
The file will be placed before the head of constitutional and human rights division for directions.
