A senior police officer has confessed how Sarah Wairimu Kamotho frustrated police efforts to have her arrested and prosecuted for assaulting her Dutch billionaire husband Tob Cohen five months before he was murdered under mysterious circumstances.
Testifying before Kibera High Judge Diana Kavedza, Superintedent James Murigu said he sent police officers four to five times to arrest Sarah in vain.
Supt Murigu said besides the assault report filed at Spring Valley and Parklands Police Stations, Sarah also filed a report at Gigiri that her late husband had also assaulted her.
Supt Murigu said the assault issue was scaled high to the Nairobi Regional complaints office from where he was ordered to take over the case from Spring Valley police station as Sarah had frustrated police from prosecuting her.
“After I was called to Nairobi Regional Complaints Office I was ordered to take over the case.I ordered my junior officers to trace Sarah, arrest her and take her to court,” Supt Murigu stated adding, “That was never to be.”
He said from that time Cohen begun to be uncooperative claiming that Sarah was still his wife and were engaged in a divorce case.
“Cohen failed completely to show police where to trace Sarah nor did he share her contacts so that they could call her,” the judge heard.
Justice Kavedza heard when police asked Cohen where to get her, he told them she had travelled overseas and would inform them once she returned.
In April 17,2019, the officer said he received a letter from Cohen seeking to withdraw the assault claim.
However later he wrote again in June 2019 claiming that he (cohen) was being bullied by police from Gigiri Police Station where Sarah had reported that her husband had assaulted her.
On June 6,2019 after he was summoned to Nairobi Regional Complaints Office, Supt Murigu wrote a brief on the efforts he was making to ensure Cohen gets justice.
“I explained in my brief to the Nairobi Regional Office that I was doing everything possible to ensure Cohen got justice,” Supt Murigu.
He added that on June 4,2019 a city lawyer Shadrack Wambui wrote to him inquiring as to why he did not prosecute Sarah for allegedly assaulting Cohen who had already reported and given a P-3 Form which had been signed by a Police Doctor- Dr Kamau.
The officer recounted that while he was at his Parklands Office on July 22,2019, he received a letter dropped by Courier Service Rider claiming to have been sent by Tob Cohen.
The letter had allegedly been written by Tob Cohen on July 20,2019 stating that he did not wish to proceed with the assault case.
He said he instructed the investigating officer one Mose Mbalwe to close the assault case file after reaching out to Tob Cohen to write a closing a statement to that effect.
“On July 23,2019 l received a call from Ms Jacinta Wasonga of Police Headquarters asking me to see her alongside the investigating officer,” the judge heard.
The witness said he explained to Ms Wasonga the position of the investigations then explained the difficulties he was experiencing in arresting Sarah.
Supt Murigu said he was instructed by Ms Wasonga to arrest Sarah since Cohen had complained to the Nairobi Regional Complaints office about the ineptitudeness of Parklands and Spring Valley police stations to arrest and arraign Sarah.
