Mohammed Warsame’s rise to Apex Court signals new chapter for Kenya’s Judiciary

Veteran appellate Judge Mohamed Warsame has been nominated by the Judicial Service Commission (JSC) to serve as a Judge of the Supreme Court of Kenya, marking a significant milestone in a judicial career spanning decades.

His nomination yesterday follows rigorous two day interviews conducted to fill the vacancy left by the late Mohamed Ibrahim, who passed away in December last year.

Warsame was born in northeastern Kenya and is aged 68.

He pursued his legal studies at the University of Nairobi, where he earned his Bachelor of Laws degree, before proceeding to the Kenya School of Law for postgraduate legal training that admitted him to the bar.

His early years in legal practice saw him build a reputation as a sharp and principled advocate, particularly in commercial and constitutional law.

Before his appointment to the bench, Warsame worked in private practice and later served in public legal roles, steadily earning recognition for his integrity and mastery of complex legal questions.

His judicial career formally began when he was appointed as a High Court judge, where he handled a wide range of cases including constitutional petitions, commercial disputes, and criminal appeals.

Warsame’s decisions during this period were often cited for their clarity, depth, and adherence to the rule of law.

In 2012, he was elevated to the Court of Appeal, where he has served for over a decade.

At the appellate level, Warsame has been part of several landmark rulings that have shaped Kenya’s legal landscape, including high stakes election petitions, major commercial disputes, and constitutional interpretation cases.

He has been particularly noted for his firm stance on judicial independence and his willingness to deliver dissenting opinions where he believes the law demands it.

Beyond the bench, Warsame has occasionally been linked to political aspirations, particularly speculation about a future bid for the Mandera gubernatorial seat upon his retirement from the judiciary.

While he has not formally declared such intentions, the prospect reflects his deep roots in the region and his potential interest in public service beyond the courts.

Within the legal fraternity, Warsame is regarded as a mentor and a symbol of judicial courage.

Many young lawyers and judicial officers cite his career as an example of professionalism, discipline, and independence.

His colleagues who talked to DNK-International describe him as a judge who is unafraid to speak his mind, especially when safeguarding the integrity of the judiciary.

He has, over the years, made memorable remarks emphasizing the centrality of the rule of law, once noting in a ruling that justice must not only be done but must be seen to be done, regardless of the status of those involved.

In another instance, he underscored that courts exist to serve the people and must remain not influenced from external pressures.

If approved by President William Ruto, Justice Warsame’s elevation to the Supreme Court is expected to strengthen the bench with his vast experience, measured temperament, and deep understanding of Kenya’s constitutional framework.

His nomination signals continuity in judicial excellence while also opening a new chapter in the country’s apex court at a time when its role in governance and constitutional interpretation remains critical.
